Terms of Service

These Terms of Service (“Terms”) govern your use of OpenMD at openmd.health, including the AI assistant, BioHack, MindCare, MedSearch, EatWell, the HomeCare marketplace, and the OpenMD API/MCP server (together, the “Service”). By using the Service you agree to these Terms and to our Privacy Policy.

1. OpenMD is not medical care

OpenMD’s AI features provide general health information, not medical advice, diagnosis, or treatment. They support — and never replace — the judgment of qualified clinicians. Never disregard or delay professional medical advice because of something OpenMD said. If you believe you are experiencing an emergency, call your local emergency number immediately. AI systems can be wrong, incomplete, or outdated, and cannot examine you.

2. The Service is free

OpenMD has no subscriptions and no paid tiers. A fair-use limit on AI calls (currently 50 per week per person) keeps the Service available to everyone. The only payments on the platform are HomeCare visit fees, described below.

3. Accounts and API keys

You may sign in with Google to create an account. You are responsible for activity under your account and API keys; keep keys secret and revoke any key you believe is compromised. We may suspend accounts that abuse the Service, attempt to circumvent fair-use limits, or use it unlawfully.

4. HomeCare marketplace

• HomeCare providers (physicians, nurses, physiotherapists, and others) are independent professionals, not OpenMD employees or agents. OpenMD verifies submitted license numbers against issuing boards before listing a provider, but the provider alone is responsible for the care they deliver.
• Providers set their own rates. Payments are processed by Stripe; providers receive 90% of each booking and OpenMD retains a 10% platform fee.
• Booking a visit creates an agreement between you and the provider. Cancellation and refund questions are resolved with the provider; contact us if you need help.
• HomeCare is not for emergencies. For emergencies, call your local emergency number.

5. Acceptable use

You agree not to:

• use the Service for unlawful purposes or to harm others;
• submit false provider credentials or impersonate any person;
• attempt to extract other users’ data, probe or overload our infrastructure, or resell the Service without permission;
• use OpenMD outputs to provide medical care without a licensed clinician.

6. Your content

You retain rights to the content you submit. You grant OpenMD the limited license needed to process it and provide the Service (for example, sending your question to our AI processor to generate your answer). We do not use your health conversations or connected Google data to train foundation models.

7. Open source

OpenMD’s code is open source at GitHub. The code license is stated in the repository; these Terms govern the hosted Service.

8. Disclaimers and liability

The Service is provided “as is” without warranties of any kind, to the maximum extent permitted by law. OpenMD is not liable for indirect, incidental, or consequential damages, or for the acts or omissions of independent HomeCare providers. Nothing in these Terms limits liability that cannot be limited by law.

9. Changes and contact
